The case was heard before Mr Justice Cook in l988. The question before the Court was whether the parents' decision that a hysterectomy be performed on their daughter was in her best interest and should be allowed to proceed. Their daughter is said to have a "severe degree of mental retardation". The case was brought through an application to prevent the operation and for the appointment of a "next friend". It was said that the young person had a phobic reaction to blood and it would be difficult to teach menstruation management. The judgement examines arguments of both parties and refers to relevant case precedents. The Judge found that the young person's welfare would be best served by the operation proceeding as planned as distinct from any of the treatments or menstrual management proposals put forward as alternatives.
